Terms & Conditions

The terms governing our products, services and website use

Last updated: January 2025

Please read these Terms & Conditions carefully before placing an order or using our website. By placing an order or using our site, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. About Us

These terms apply to QPack ("we", "us", "our"), a custom packaging and printing business based in the United Kingdom. Our registered address is:

QPack
60c Bridge Street
Kington
HR5 3DJ
United Kingdom

Contact: sales@qpack.co.uk | +44 74 0075 8560

2. Quotations & Orders

  • All quotations are provided free of charge and are valid for 30 days from the date issued, unless otherwise stated.
  • A quotation does not constitute a binding contract. A contract is formed only when we issue a written order confirmation following receipt of your approved artwork and deposit payment.
  • We reserve the right to withdraw or amend a quotation at any time before an order is confirmed.
  • Minimum order quantities (MOQs) may apply and will be stated in your quotation.
  • Prices are quoted in pounds sterling (GBP) and are exclusive of VAT unless stated otherwise. VAT will be added at the prevailing UK rate where applicable.

3. Artwork & Proofs

  • It is your responsibility to supply print-ready artwork that meets our technical specifications. We will advise on requirements at the time of ordering.
  • We will provide a digital proof for your approval before production begins. Production will not start until written approval is received from you.
  • By approving a proof, you confirm that all text, images, colours, dimensions and other details are correct. We are not liable for errors approved by you.
  • Significant changes to artwork after proof approval may incur additional charges and delay delivery.
  • We accept no liability for colour variation between on-screen proofs and the final printed product, as monitor calibration varies. Physical print samples are available on request and may be subject to a fee.
  • All artwork, files and designs you supply remain your intellectual property. We will not use them for any other purpose.

4. Payment Terms

  • A deposit of 50% of the order value is required before production begins, unless a credit account has been agreed in writing.
  • The remaining balance is due prior to despatch of goods, unless alternative terms have been agreed.
  • Approved credit account customers must pay within the agreed credit terms (typically 30 days net from invoice date).
  • We accept payment by bank transfer (BACS), card payment and other methods as agreed.
  • We reserve the right to charge interest on overdue invoices at 8% per annum above the Bank of England base rate, under the Late Payment of Commercial Debts (Interest) Act 1998.
  • Ownership of goods remains with QPack until full payment has been received.

5. Production & Lead Times

  • Lead times are estimates based on current workload and are given in good faith. They begin from the date of written proof approval and receipt of the required deposit.
  • We will notify you as soon as possible if a delay is likely. We are not liable for delays caused by circumstances beyond our reasonable control (see Section 10).
  • Rush/express production may be available at an additional charge. Contact us to discuss your requirements.

6. Delivery

  • Delivery is to the address specified in your order. Any changes to the delivery address must be notified to us in writing before despatch.
  • Delivery charges will be quoted separately and added to your invoice unless agreed otherwise.
  • Risk in the goods passes to you on delivery. Please inspect all deliveries promptly and report any damage or discrepancy to us within 48 hours of receipt.
  • We cannot accept liability for loss or damage reported after this period.
  • For large or pallet deliveries, a signature may be required. Signing without noting visible damage may affect any claims.

7. Returns, Defects & Reprints

  • As all products are custom-manufactured to your specification, we do not accept returns for change of mind or incorrect specification supplied by you.
  • If goods are defective due to a manufacturing error on our part, notify us within 7 days of delivery with photographic evidence. We will, at our discretion, offer a reprint, credit or refund.
  • Minor variations in colour, quantity (Β±5%) and dimensions that are within industry-standard tolerances do not constitute defects.
  • We do not accept responsibility for errors in artwork that were approved by you at the proof stage.

8. Intellectual Property

  • You warrant that you own or have the right to use all content, logos, images and trademarks supplied to us as part of your order, and that such use does not infringe any third-party rights.
  • You indemnify us against any claims, losses or expenses arising from any infringement of third-party intellectual property rights in the material you supply.
  • All design work, templates and artwork created by QPack remain the intellectual property of QPack unless otherwise agreed in writing.

9. Limitation of Liability

  • Our total liability to you in respect of any order shall not exceed the total value paid by you for that order.
  • We are not liable for any indirect, consequential or special losses, including loss of profit, loss of business or reputational damage, however caused.
  • Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.

10. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations caused by events outside our reasonable control, including but not limited to: acts of God, war, industrial action, fire, flood, pandemic, government restrictions, failure of third-party suppliers or transport disruptions. We will notify you promptly and take reasonable steps to minimise the impact of any such event.

11. Website Use

  • Our website is provided for information and enquiry purposes. We make no warranties that it will be uninterrupted or error-free.
  • You may not use our website for any unlawful purpose or in a way that infringes the rights of others.
  • Links to third-party websites are provided for convenience only. We are not responsible for the content of any third-party site.

12. Data Protection

We process personal data in accordance with our Privacy Policy and in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

13. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. The current version will always be published on this page. Continued use of our services after any changes constitutes acceptance of the updated terms. Where changes are material, we will notify active customers by email.

14. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
